UC has launched a “fact-finding mission” into the issue.
For
years, Maylei Blackwell has worked to lift up Indigenous and Chicana
women’s voices as a UCLA professor who identified as a mixed-race person
of Thai and Cherokee heritage. Her research was widely cited, her use
of oral histories praised. Her most recent book was poised to receive a
prestigious award last year from a Native American and Indigenous
studies association.
Then came a bombshell revelation.
The
scholars association abruptly rescinded the award after allegations
surfaced last spring that Blackwell’s claims of Cherokee heritage, based
on family stories, were phony. In a public apology, Blackwell confessed
that her research triggered by the allegations found her mother was
white. She vowed to seek repair for harms caused. The furor reverberated
nationally after Charlene Villaseñor Black, chair of Blackwell’s
Department of Chicana/o and Central American Studies, posted a public
message of gratitude to the Indigenous scholars who brought the issue to
light.
Now
the University of California, following several cases of questioned
Native American identity over the last few years, has launched a
“fact-finding mission” on the issue, according to UC Academic Senate
Chair Steven W. Cheung. UC provided no details on the scope of the
effort. But the action comes after UC Native American scholars held
their first symposium last year on what they say is a growing problem of
what are called “Pretendians” — pretend Indians — in the UC system and
across academia nationwide.
“We
just decided that people need to start talking about this in the system
or it’s going to keep happening,” said Phenocia Bauerle, UC Berkeley
director of Native American Student Development, who has helped lead
efforts for action. “There are so many people pretending to be Native,
so I do think people who are claiming it, who are building their careers
on it, should have to prove it.”

Confirmation process moving slowest since George Washington admin
Not since President George Washington's initial formation of a cabinet in 1789 has an American president's cabinet picks been approved as slowly as the Senate is approving President Donald Trump's nominees.
Trump has now been president for a full three weeks, and the number of approved members in his cabinet stands at seven—a number that was boosted by three contested confirmations last week that were opposed by almost the entire Democratic caucus.
Senate Democrats, vowing to use "everything" they can to stop Trump's nominees, have used procedural tricks like boycotting committee meetings to slow the confirmation process to a historically slow pace.
Recent administrations have had many more nominees approved at the three-week mark. Barack Obama had 12 out of 15 nominees approved, George W. Bush had his entire cabinet approved, and Bill Clinton had all but one approved in less than a day.
For most of history, approving cabinet nominees has been a non-issue. Presidents John Kennedy, Richard Nixon, and Jimmy Carter had their entire cabinet approved in the first days of their presidency—a brisk pace that has been the norm for most of U.S. history.
As noted by historian Robert David Johnson, the only confirmation process at all comparable to the current situation was that of President George H.W. Bush, and even he had 10 of his 14 nominees confirmed by the three-week mark.
One difference between Trump and Bush, however, is that Bush was facing a Democratic-controlled Senate that actually had the power to stop his nominations.
With Republican control of 52 seats in the Senate and current rules mandating just a simple majority for approval, it seems likely that Trump's prediction that his cabinet picks will be confirmed will eventually be correct.
Senate Democrats, however, continue to delay the inevitable.
Ben Carson (Department of Housing and Urban Development), Rick Perry (Department of Energy), Ryan Zinke (Department of the Interior), David Shulkin (Department of Veterans Affairs), Steve Mnuchin (Department of Treasury), and Wilbur Ross (Department of Commerce) have all been approved by the necessary committees and are awaiting votes in the full Senate.
So far, only Mnuchin and Shulkin have a vote scheduled, both for Monday.
The continuing obstruction of even uncontroversial cabinet choices is being driven by demands from the liberal base of the Democratic Party, which is demanding that Democratic lawmakers not cooperate with Trump on anything.
"Democrats, pushed by their base, are under pressure to not cooperate with the new president—on anything," wrote the Wall Street Journal following reports that Democrats boycotted committee hearings for multiple nominees.
"Gone are the concerns about appearing overly obstructionist," Politico reported. "Officeholders are now chasing a base that will not tolerate any sign of accommodation."

Attorney General Loretta Lynch met privately with former President Bill Clinton on Monday night at the Phoenix international airport, ABC 15 reported.
The meeting came hours before the House Benghazi Committee on Tuesday released a report on the 2012 terror attacks in Libya. Lynch told reporters the two did not discuss the issue.
"Our conversation was a great deal about grandchildren, it was primarily social about our travels, and he mentioned golf he played in Phoenix," Lynch said.
"There was no discussion on any matter pending before the Department or any matter pending with any other body, there was no discussion of Benghazi, no discussion of State Department emails, by way of example I would say it was current news of the day, the Brexit decision and what it would mean."

On Thursday, the Minnesota Department of Commerce is scheduled to release 2016 rates for shoppers who buy individual policies.
Four insurers that collectively cover most people in the market are seeking average increases of more than 20 percent each, including a proposed jump of more than 50 percent for about 179,000 people with coverage from Eagan-based Blue Cross and Blue Shield of Minnesota — the state’s largest health insurer.
In ruling on the requests, regulators must walk a line between satisfying consumers who want low rates and insurers who say the business can’t be sustained at current premium levels.
“We are dying here under the weight of insurance premiums,” Kristi Nelson, 53, of Hastings, wrote Commerce Department officials in opposition to a possible rate increase. “It’s like being dropped off a cliff every year when the new premiums come out.”
The proposed rates apply to Minnesota’s individual market, where roughly 6 percent of state residents bought coverage last year. That market has changed markedly with the federal Affordable Care Act.

Protesters who claimed affiliation with the Black Lives Matter movement stormed the stage during a rally for Sen. Bernie Sanders (I-Vt.) in Seattle on Saturday, taking over the microphone and forcing Sanders to leave without ever speaking.
Moments after Sanders took the stage at Westlake Park, two women and one man climbed the stage and confronted the Democratic presidential candidate, demanding a chance to speak.
After several moments of confusion and confrontation, an event organizer took the microphone and said the protesters would be allowed to speak before Sanders. Some in the crowd booed.
One protester, who identified herself as Marissa Johnson, began by saying, “I was going to tell Bernie how racist this city is — with all of its progressives — but you’ve already done that for me. Thank you.”
CNN reports that Marissa Johnson is a co-founder of BLM in Seattle.

As usual, the headline in the left-leaning media and the article that follows never tells the full story. The Governor of Wisconsin Scott Walker has been a target of the left for years now and the recall election that failed has made the left even more bitter. First an excerpt from TheHill.com
Wisconsin Gov. Scott Walker (R) did not violate campaign finance laws during recall elections against him, the Wisconsin Supreme Court decided in an opinion released Thursday.
Wisconsin’s highest court ruled on Thursday that Walker did not illegally collaborate with conservative groups during 2011 and 2012 recall campaigns.
The ruling ends a significant legal challenge against Walker just three days after his entrance into the GOP’s 2016 presidential field. It halts any continuing investigation or legal discovery that could tarnish the Wisconsin governor’s image heading into next year.
The justices involved with the case split 4-2.
Justice Michael Gableman wrote in the court’s majority decision that the campaign finance law at issue in the case is “unconstitutionally overbroad and vague.”
“To be clear, this conclusion ends the John Doe investigation because the special prosecutor’s legal theory is unsupported in either reason or law,” he said. “Consequently, the investigation is closed.”

Last year’s predawn raids against Wisconsin conservatives and subsequent legal harassment from prosecutors suggest a police state.
In the predawn hours of October 3, 2013, armed deputies raided the homes of R.J. Johnson, Deborah Jordahl, and several others in a paramilitary style blitz across Wisconsin. The detainees weren’t terrorists bent on mass murder or the overthrow of the government. The agents weren’t looking for contraband narcotics or illegal firearms. In fact, no one was quite sure what they wanted, but agents got it all; computers, phones, business records, files, and communications dating back years. Deputies told the raided subjects to keep quiet or there would be consequences, as a pedophile might tell his prey.
The targets represent only a fraction of political activists sucked into Milwaukee County District Attorney John Chisholm’s “John Doe”—a grand-jury-type mechanism Wisconsin prosecutors prefer for its secrecy. Chisholm accuses them of “illegal talking” by coordinating messaging, which is supposedly forbidden under Wisconsin’s prolix campaign finance code. The investigation, which Chisholm has expanded 18 times, has engulfed advocates, large and small, for years on end. His favorite tactic is bulk intimidation. Alongside raids and gag orders, he employs kitchen-sink subpoenas, many of which are eventually quashed at great legal expense. When he fails to get sufficient obeisance, he serves arrest warrants and sends people to jail on nonexistent charges. One judge reviewing a John Doe prosecutor’s actions stated, “The conduct described is nothing that we as Wisconsinites should be proud of, bottom line . . . . Mr. Landgraf was behaving badly, probably for political reasons.”

Chisholm’s John Doe represents the worst kind of legal thuggery, rife with personal enmity, conflicts of interests, and professional skullduggery. Unfortunately victims are left with little practical recourse. The laws, judicial doctrines, and disciplinary structures that shield Chisholm and his cohorts should be reformed to prevent this type of abuse from ever happening again.

Washington, DC) – Judicial Watch today released new Department of Justice (DOJ) and Internal Revenue Service (IRS) documents that include an official “DOJ Recap” report detailing an October 2010 meeting between Lois Lerner, DOJ officials and the FBI to plan for the possible criminal prosecution of targeted nonprofit organizations for alleged illegal political activity.
The newly obtained records also reveal that the Obama DOJ wanted IRS employees who were going to testify to Congress to turn over documents to the DOJ before giving them to Congress. Records also detail how the Obama IRS gave the FBI 21 computer disks, containing 1.25 million pages of confidential IRS returns from 113,000 nonprofit social 501(c)(4) welfare groups – or nearly every 501(c)(4) in the United States – as part of its prosecution effort. According to a letter from then-House Oversight Committee Chairman Darrell Issa (R-CA) to IRS Commissioner John Koskinen, “This revelation likely means that the IRS – including possibly Lois Lerner – violated federal tax law by transmitting this information to the Justice Department.”

The new IRSdocuments include a October 11, 2010 “DOJ Recap” memo sent by IRS Exempt Organizations Tax Law Specialist Siri Buller to Lerner and other top IRS officials explaining an October 8 meeting with representatives from the Department of Justice Criminal Division’s Public Integrity Section and “one representative from the FBI” to discuss the possible criminal prosecution of nonprofit organizations for alleged political activity:
On October 8, 2010, Lois Lerner, Joe Urban [IRS Technical Advisor, TEGE], Judy Kindell [top aide to Lerner], Justin Lowe [Technical Advisor to the Commissioner of Tax-Exempt and Government Entities], and Siri Buller met with the section chief and other attorneys from the Department of Justice Criminal Division’s Public Integrity Section, and one representative from the FBI, to discuss recent attention to the political activity of exempt organizations.
The section’s attorneys expressed concern that certain section 501(c) organizations are actually political committees “posing” as if they are not subject to FEC law, and therefore may be subject to criminal liability. The attorneys mentioned several possible theories to bring criminal charges under FEC law. In response, Lois and Judy eloquently explained the following points:
Under section 7805(b), we may only revoke or modify an organization’s exemption retroactively if it omitted or misstated a material fact or operated in a manner materially different from that originally represented.
If we do not have these misrepresentations, the organization may rely on our determination it is exempt. However, the likelihood of revocation is diminished by the fact that section 501(c)(4)-(c)(6) organizations are not required to apply for recognition of exemption.
We discussed the hypothetical situation of a section 501(c)(4) organization that declares itself exempt as a social welfare organization, but at the end of the taxable year has in fact functioned as a political organization. Judy explained that such an organization, in order to be in compliance, would simply file Form 1120-POL and paying tax at the highest corporate rate.
Lois stated that although we do not believe that organizations which are subject to a civil audit subsequently receive any type of immunity from a criminal investigation, she will refer them to individuals from CI who can better answer that question. She explained that we are legally required to separate the civil and criminal aspects of any examination and that while we do not have EO law experts in CI, our FIU agents are experienced in coordinating with CI.
The attorneys asked whether a change in the law is necessary, and whether a three-way partnership among DOJ, the FEC, and the IRS is possible to prevent prohibited activity by these organizations. Lois listed a number of obstacles to the attorneys’ theories:

Just prior this meeting, the IRS began the process of providing the FBI confidential taxpayer information on nonprofit groups. An IRS document confirms the IRS supplied the FBI with 21 disks containing 1.25 million pages of taxpayer records:
The coordination of the agencies with the administration and the Democrats in Congress is really no surprise, but does pose a final question.
The DOJ documents also include a July 16, 2013, email from an undisclosed Justice Department official to a lawyer for IRS employees asking that the Obama administration get information from congressional witnesses before Congress does:

“These new documents show that the Obama IRS scandal is also an Obama DOJ and FBI scandal,” said Judicial Watch President Tom Fitton. “The FBI and Justice Department worked with Lois Lerner and the IRS to concoct some reason to put President Obama’s opponents in jail before his reelection. And this abuse resulted in the FBI’s illegally obtaining confidential taxpayer information. How can the Justice Department and FBI investigate the very scandal in which they are implicated?”

The same IRS office that deliberately targeted conservative groups applying for tax-exempt status in the run-up to the 2012 election released nine pending confidential applications of conservative groups to ProPublica late last year.
The IRS did not respond to requests Monday following up about that release, and whether it had determined how the applications were sent to ProPublica.
In response to a request for the applications for 67 different nonprofits last November, the Cincinnati office of the IRS sent ProPublica applications or documentation for 31 groups. Nine of those applications had not yet been approved—meaning they were not supposed to be made public.
ALL 9 of the groups are not only conservative, but one of the illegally leaked applications was for the Karl Rove lead Crossroads GPS, the largest and most hated group among them. Smaller and lesser known conservative groups confidential applications were also illegally leaked as Propublica reuports:
Applications were sent to ProPublica from five other social welfare groups that had told the IRS that they wouldn’t spend money to sway elections. The other groups ended up spending more than $5 million related to the election, mainly to support Republican presidential candidate Mitt Romney. Much of that money was spent by the Arizona groupAmericans for Responsible Leadership. The remaining four groups that told the IRS they wouldn’t engage in political spending were Freedom Path, Rightchange.com II, America Is Not Stupid and A Better America Now.
The IRS also sent ProPublica the applications of three small conservative groups that told the agency that they would spend some money on politics: Citizen Awareness Project, the YG Network and SecureAmericaNow.org. (No unapproved applications from liberal groups were sent to ProPublica.)
That is right, NONE of the unapproved applications for liberal groups were leaked. The public and the press were eager to dismiss the targeting of conservatives by the Obama administration, BIG government and the Democrat party.

The Internal Revenue Service diverted applications for tax-exempt status from tea party and like-minded organizations to a special track known as Group 7822 for special scrutiny, according to transcripts of an interview by congressional interrogators with a key IRS official.
A conservative watchdog group, Judicial Watch, said it obtained an email chain from the Internal Revenue Service in which the department provided confidential tax information to the Federal Election Commission.
The watchdog group obtained the exchange from a freedom of information request made shortly after congressional investigators began prodding the agency on whether it inappropriately shared confidential tax information about a conservative group applying for tax-exempt status.

According to the latest U.S. Census Bureau data, 95 percent of Puerto Rico residents above age 5 speak Spanish at home, and about 84 percent say they do not speak English “very well.”
The inspector general noted that a nurse in Puerto Rico who speaks only Spanish could be considered “unskilled” under current Social Security standards.
“A claimant’s inability to communicate in English can lessen the relevance of work experience and education, potentially making it more likely the claimant will receive disability benefits,” the report said.
Individuals born in Puerto Rico are U.S. citizens, making them eligible to apply for Social Security benefits. However, they do not automatically qualify for disability payments.
The horror of not being able to speak English in a Spanish speaking country. After all, this really isn't America, but these U.S. citizens don't have to pay federal income taxes. Imagine that burden alone for these oppressed people ? Of course, Puerto Rico does require that you pay a 4% income tax rate.(Compare that to your combined federal and state income tax burden you may pay now! Legally avoid the 39.6% federal rate and the 13.3% California (or other state) rate?) This hefty 4 percent income tax rate is quite a burden, now add in the ZERO percent tax rate on dividends. If you are receiving distributions of company profits or have investments yielding dividends, they are tax-free. There’s also no capital gain tax in Puerto Rico. If you sell your company, sell real estate, sell shares in public companies, you name it, no capital gain tax. These burdens of their imperialist masters know no bounds.
Puerto Rico always rejects a move to statehood for some unknown reason. Of course, The Popular Democratic Party (PPD) Partido Popular Democratico followers are known as "los populares", identified by color red and supports an enhanced commonwealth status. Their current governor is a popular Democrat and has led them into debt and poverty, just like the Democrats in Detroit. His background in 'academia and public service', with a short stint as an attorney was no real surprise.

Puerto Rico’s governor, saying he needs to pull the island out of a “death spiral,” has concluded that the commonwealth cannot pay its roughly $72 billion in debts, an admission that will probably have wide-reaching financial repercussions.
The governor, Alejandro García Padilla, and senior members of his staff said in an interview last week that they would probably seek significant concessions from as many as all of the island’s creditors, which could include deferring some debt payments for as long as five years or extending the timetable for repayment.
“The debt is not payable,” Mr. García Padilla said. “There is no other option. I would love to have an easier option. This is not politics, this is math.”
It is a startling admission from the governor of an island of 3.6 million people, which has piled on more municipal bond debt per capita than any American state.
Not politics but math ? Really? These math whizkids racked up more debt than any American state and that is not a simple task. So now we know this is really politics coming from this math challenged island paradise. This sly Democrat politician heading Puerto Rico thinks the beneficiaries of this spending shouldn't be burdened with paying it back. What kind of debt are we talking about ? The NYTimes mentions that the 'public corporations' are responsible for about a third. So the citizens don't want to pay their fair share of their water and electric bills either?
In Washington, the García Padilla administration has been pushing for a bill that would allow the island’s public corporations, like its electrical power authority and water agency, to declare bankruptcy. Of Puerto Rico’s $72 billion in bonds, roughly $25 billion were issued by the public corporations
Add in the other $50 billion in pension obligations. Sure why should the recipients of these services have to pay for the pension obligations of the workers that provide these services too?
There is no better time than now to cut the apron strings and set the Spanish speaking island free and let it make its way in the real world. Do it in the name of Freedom !!
The Clintonistas have to explain away Hillary's previous stances on issues or just blatantly lie and say she has always been a 'progressive' and has never changed a position. Either approach will work on the Kool Aid drinking base of the Democratic Party that is blinded by identity politics and party propaganda. The Democrats are called zero information voters for good reason. Emotions can't be wrong or change based on facts or real information. Cognitive dissonance is required to be a supporter of anything Hillary Clinton or leftist in genera. Hillary Clinton is a progressive populist of convenience and her supporters really couldn't care less. Even the fact that they cannot name a single accomplishment of hers won't stop them from blindly supporting her.
Is Hillary Clinton’s embrace of populist and/or progressive rhetoric and policy positions consistent with her long-held convictions? Or is she only doing it belatedly, to shore up her support on the left, and to keep pace with the passions unleashed among Democrats by the rise of Elizabeth Warren and other factors?
The question gained some steam last week when Clinton shifted her stances on two key issues. She came out for a Constitutional right to gay marriage, when previously she’d said it should be left to the states, and embraced drivers’ licenses for undocumented immigrants, a position she’d previously opposed.
The reporter then points out the obvious fact. Almost all the Democrats have morphed their positions on key issues to pander to the coalition of the left.
The real story here, I think, is what this all says about the changing nature of the Democratic Party.
It’s true that Clinton has plainly evolved her positions on gay marriage and immigration. But large swaths of the Democratic Party have evolved on these issues, too. There has been a stampede of high level Democrats coming out in support of gay marriage in recent years, in a scramble to keep pace with cultural changes that have caught everyone off guard. On immigration, the party is more unified in support of reform than it has ever been, partly a reflection of its increasingly reliance on Latinos. All of this movement is an outgrowth of a broader Democratic Party shift towards the cultural priorities of the coalition that powered Obama victories in the last two national elections — nonwhites, millennials, socially liberal college-educated whites — and away from a reliance on culturally conservative blue collar whites.
