3 Blagojevich cronies in federal court this week
Former Governor Rod Blagojevich has been in a Colorado prison for four months now but his coattails still dangle in Illinois.
In this Intelligence Report: The luck of the draw this week brings together three of Blagojevich's top cronies separately in federal court this week.
Tuesday, Wednesday and Thursday the troika of former Blagojevich buddies will have their cases called in federal court. Ali Ata and Stuart Levine will be sentenced, and Bill Cellini will attempt to have his sentencing put off.
Even though their cases were all separate prosecutions, they were all beholden to Blagojevich.
Chicago businessman Ata pleaded guilty to lying to the FBI in an effort to cover his tracks with Governor Blagojevich and corrupt developer Tony Rezko.
Ata also pleaded to tax fraud. As part of his plea deal with the government, he agreed to a 12-to-18 month prison sentence. Tuesday, though, according to a court filing, Ata's attorney will ask that the 60-year-old Jordanian native be given probation in consideration for his lengthy cooperation with prosecutors and testimony. Judge James Zagel will decide and impose sentence.
Then, on Wednesday, it will also be Judge Zagel who will decide whether to grant a motion by corrupt business tycoon William Cellini to postpone his sentencing.
After a career of backstage wheeling and dealing, Cellini was convicted in November of trying to shake down a Hollywood producer for Blagojevich campaign contributions. The 77-year-old had a heart attack last month followed by a blood clot. Prosecutors want an eight-year sentence.
Finally, on Thursday, serial swindler Stuart Levine will be sentenced.
Levine testified against both Cellini and Rezko and helped to convict both of the former Blagojevich financiers. Levine pleaded guilty to a money laundering and tax fraud."


 "And, if that isn't already a week's worth of corruption, Tuesday will also see former Blagojevich fundraiser Raghuveer Nayak in court for a hearing in his medical kickback case. Nayak was the link between Blagojevich and Jesse Jackson Jr. in the infamous "golden" U.S. Senate seat."

Ali Ata

A federal judge has sentenced a former Illinois official to four years' probation for donating $50,000 to then-Illinois Gov. Rod Blagojevich's campaign in exchange for a state job.
Ali Ata spoke briefly in court Tuesday, apologizing for his actions. The judge also ordered Ata to pay a $50,000 fine. Ata is the former director of the Illinois Finance Authority.
His testimony at Blagojevich's first corruption trial helped convict the impeached governor on one count of lying to the FBI about fundraising. Ata did not testify at Blagojevich's retrial, which resulted in more convictions.
Ata pleaded guilty to making false statements to a government agent and to filing a false income tax return.

 Key witness in Blagojevich probe gets 5 1/2 years

— A judge on Thursday sentenced one of the most unsavory figures to emerge from the investigation of former Illinois Gov. Rod Blagojevich to just 5 1/2 years in prison, heeding praise for the former political insider as one of the most important cooperating witnesses in the state's sordid history of corruption.
Moments before the judge announced the sentence for money laundering and fraud, a somber Stuart Levine stood ramrod straight at a courtroom podium, apologizing for a laundry list of scams in which he used influence on state boards to line his pockets with millions of dollars.
"I wish to express my deep regret to the people of Illinois," said the admitted former drug addict and serial swindler, now 66. He added that he has "profound remorse and deep regret for all that I have done."
Otherwise composed, his voice momentarily cracked as he also apologized to his children for the pain he caused them.
Later, Judge Amy St. Eve acknowledged Levine played central roles in bringing several public figures to justice. But she said he also cheated business partners, hospitals, charities and others - once even swindling a dead friend's estate and the man's deaf daughter out of $2 million.
His schemes included using a seat on the Illinois Health Facilities Planning board to shake down hospitals for kickbacks. And he ran similar swindles at the $40 billion state teachers' pension fund.
"You are certainly one of the most corrupt individuals this district has ever seen," the judge told him. "It is clear you would stop at nothing for your greedy ends."
Levine, who must report to prison on Sept. 27, faced a maximum life sentence. In the end, though, the judge chose to impose the term prosecutors recommended in a 2006 plea deal.
In his remarks, prosecutor Chris Niewoehner praised Levine for trial testimony that helped convict former Blagojevich fundraiser Tony Rezko and longtime Illinois powerbroker William Cellini.
Levine didn't testify at Blagojevich's trials. But Niewoehner said he deserved substantial credit for evidence that led to the conviction of Blagojevich, who is serving a 14-year term for corruption.

"Springfield power broker William Cellini's sentencing for his federal corruption conviction was delayed Wednesday until Oct. 4. Cellini, who suffered a heart attack last month, was scheduled to be sentenced Monday, but U.S. District Judge James Zagel agreed to the delay. Cellini is unable to travel from Springfield because of his health, his attorney, Dan Webb, told reporters after court. In recent court papers, federal prosecutors said Cellini, 77, faces 61/2 to eight years in prison under federal sentencing guidelines but also offered that this might be the rare case for a defendant to receive a somewhat shorter prison term because of his health and age. Still, prosecutors said Cellini should be given "a meaningful sentence of incarceration."

CHICAGO (CBS) — "A key figure in the Rod Blagojevich corruption case was arrested on Wednesday on federal fraud and tax charges.
Raghuveer Nayak was a top fund-raiser for Blagojevich and U.S. Rep. Jesse Jackson Jr.
Nayak, according to investigators, had offered to raise millions of dollars in campaign cash for the former governor, hoping it would help Jackson secure an appointment to President Obama’s old Senate seat. He also admittedly paid to have restaurant hostess Giovanna Huidobro, with whom Jackson was having an affair, flown between Chicago and Washington, D.C. on two occasions.
The charges filed on Wednesday have noting to do directly with the Blagojevich case. Federal authorities allege Nayak paid bribes and kickbacks to other physicians for patient referrals and filed false tax returns that understated his income"

"Nayak, 57, was charged with 10 counts of mail fraud, five counts of interstate travel in aid of racketeering, and four counts of filing false income tax returns for the years 2005-08.
Although the charges have nothing to do with the Blagojevich or Jackson allegations, some observers believe Nayak’s arrest could be part of an effort by the feds to squeeze Nayak for information on a more prominent target.
Attorney Michael Ettinger, who successfully defended Blagojevich’s brother Robert, said it’s interesting that the FBI arrested Nayak at his home, instead of just mailing him a notice to appear in court.
“You’re in custody. You’re arrested. And when you get a notice to appear, you’re not in custody. You walk in the building through the front door,” Ettinger said. “I’m speculating they want to squeeze him on something. He cooperated with the government, and not only did they charge him subsequently, but they arrested him.”

"Ettinger said it appears the feds are playing hardball with the physical arrest because they want to press Nayak to cooperate in an investigation of a higher value target.
“They went to this extent, and arrested him at home? There’s something going on beyond these charges. You know it, I know it, just from our experience. I don’t think it’s right,” Ettinger told CBS 2′s Mike Parker.
A federal judge set Nayak’s bond at $10 million at a hearing on Wednesday, and Nayak agreed to put up six pieces of property in Illinois and Indiana as collateral. He was released from custody immediately after the hearing and ran out of the courthouse to avoid reporters."

With all of the attention on the Supreme Court ruling on Obamacare, the sad state of the economy and the 2012 elections, Patrick Fitzgerald left his post with the US Justice Department with glowing remarks from the mainstream media.

“The relentless U.S. Attorney for the Northern District of Illinois ended his 11-year run as Chicago’s top federal prosecutor Friday, retiring from an office that brought countless criminals to justice.
“I think his legacy will be that he raised the bar of what it means to be a U.S. Attorney in Chicago. It’s a great office with a great history. Pat came from outside and over 10 years built upon that history to leave the office better than he found it,” said Zachary Fardon, who prosecuted former Gov. George Ryan under Fitzgerald and now is a defense lawyer.
“He did that through hard work, but most important was his purity of intentions, the earnestness of his convictions, and his kindness of heart, all of which motivated everyone around him to be better. That’s hard to act to follow.”
The end of Fitzgerald’s run was a sprint to the finish.
On Thursday, his office announced a significant public corruption investigation against two former elected officials — Joseph Mario Moreno and Ambrosio Medrano.
Last week, the FBI arrested Raghuveer Nayak, a political fund-raiser who was a key figure in the Rod Blagojevich corruption case as well as a man close to U.S. Rep. Jesse Jackson, Jr.”

"One day after the FOX 9 Investigators reported that as many as 24,000 Minnesota drivers licenses may be frauds, a state employee working in Secretary of State Mark Ritchie's department appeared in court to face charges that she fraudulently obtained a drivers license and housing assistance.

A federal indictment was unsealed on Monday, revealing that a 53-year-old Woodbury woman who works as an administrative assistant in the Secretary of State's Office has been accused of using an alternate identity to receive more than $18,000 in low-income housing help from the United States Department of Housing and Urban Development."

Who is this Lady and what ways did she use her new Identity?
"The charging documents say Oluremi George, a native of Nigeria and naturalized citizen, lied about her income and used the fraudulent Social Security number four times between 2008 and 2011, and she also obtained a drivers license in 2009.
Prosecutors claim George also previously submitted a passport application under the name Ayoola with the fraudulent Social Security number in July of 2007."
 Did She Vote?
"FOX 9 News checked to see if Victoria Ayoola had voted in recent elections, and it appears that she did; however, she did not use her legitimate identity to vote. "

Where else does this lead?
 Investigators: 10,000 Minn. drivers licenses canceled in possible fraud

ST. PAUL, Minn. (KMSP) -
"For an identity thief, a legitimate, valid Minnesota driver's license under an assumed name is the Holy Grail.
Get one of these you have it made: credit card and mortgage fraud. Get stopped by a cop, hop on an airplane, no problem.
And while we may think a driver's license is the gold standard for identity, come to find out there are tens of thousands of very real DLs for very fake people."

 What could possibly happen on Mark Ritchie's watch?
"Of these 24,000 driver's licenses, about 10,000 have been canceled. Beyond that, not much else has been done. Not a single name has been given yet to the Department of Human Services to check for welfare or food stamp fraud, and no names have been given or the Secretary of State to check against the voter rolls.
And what about criminal prosecution? Well, that is a very good question.
"All I can say we've referred 5,500 cases to an agency who can take any action necessary," Neville said.
But the state won't say which law enforcement agency, and the FOX 9 Investigators could only find a handful of prosecutions.
Those include people like Edward Sistrunk, aka Antonio Andolini, convicted last month for mail fraud and identity theft. He had state ID cards and Minnesota driver's licenses under at least nine different names.
Under one identity alone he got 10,381 in benefits from Hennepin County Human Services and another $1,190 in housing assistance from Anoka County. He used those real IDs to get credit cards, counterfeit checks, and even other IDs in South Dakota."

 Mark Ritchie currently has used his power of Secretary of State to change the ballot title to 2 Amendments to the State Constitution.  He altered the title to the Voter ID Amendment, which he opposes, and the Marriage is between a man and woman Amendment. He also opposes it. As mentioned in the previous blog, the Governor Dayton, his family and influential friends  have given the most to oppose the Marriage Amendment.

Mark Ritchie Alters Title for Voter Photo ID Amendment

'Minnesota Secretary of State Mark Ritchie has reworked the title for a constitutional amendment seeking to impose a photo ID requirement for voting.

The state elections chief announced in a news release Monday that the ballot question would carry the following title: "Changes to In-Person & Absentee Voting & Voter Registration; Provisional Ballots."

Sponsors of the measure had set the title previously as "Photo Identification Required for Voting."

The announcement comes as Ritchie, a Democrat, was sued for substituting a title on the amendment to define marriage in the state constitution as between one man and one woman.
Backers of the amendment object to his reworked title and say he is casting their measure in a negative light and overstepping bounds by crafting his own.

Ritchie has declined comment.'

No loaded words like" limiting", marriage as a status and the nice pc phrase opposite sex couples. Which phrase applies better to the description on the ballot below?

"Shall the Minnesota Constitution be amended to provide that only a union of one man and one woman shall be valid or recognized as a marriage in Minnesota?

"Minnesotans United for All Families has attracted some big-name support, including Gov. Mark Dayton, who is hosting a gay pride reception today.
Indeed, the Dayton name is spattered throughout the finance report. Dayton's sons Andrew and Eric earlier this month pledged $200,000 in matching funds. According to the report, the two contributed more than $25,000 each to the group, and other members of the Dayton family donated as well.
Meanwhile, William Messinger, the current husband of Dayton's ex-wife Alida Messinger, donated $10,200 to the cause.
Alida Messinger, the daughter of John D. Rockefeller III, is a prominent liberal donor who played an instrumental role in getting Dayton elected in 2010. Minnesotans United for All Families received a donation of $15,000 from the Rockefeller Family Fund; Eric Dayton serves as one of the fund's trustees, according to a 2010 federal tax document."




Once you investigate Mark Ritchie, his connection as 'friend' of the New Party, Barack Obama's membership in the New Party, felons for Franken, Soros's secretary of state project and the last election disaster,  this meddling and its purposes will be clear. The democrats can only deceive, game and abuse the system to further their agenda.

Please keep that fact in mind when you read about Harry Reid and the democrats gaming the budget systems to AVOID ANY ACCOUNTABILITY for the Economic Disaster caused by the DEMOCRATS.and the performance of the POTUS and his  economic 'team'. The Election is now months away after years without a budget.

 In the narrowest technical sense, Republicans are right — Senate Democrats haven’t passed a “budget resolution” since 2009. And it’s true that a big part of the reason for the delay is that vulnerable Democrats don’t want to associate themselves with a tax-and-spending plan that will, by necessity, envisage high deficits, some tax increases, and unpopular spending cuts, for years to come

But the much more important fact Republicans have left out is that the Senate passed a budget on an overwhelmingly bipartisan basis last summer — one that unlike an annual “budget resolution” has the force of law behind it. The Budget Control Act — the law that resolved the debt limit fight — set binding appropriations caps for this fiscal year and the next and instituted a mechanism to contain spending on domestic discretionary programs — education, research, community health programs and the like — through the next decade.

Senate's all-day budget debate dominated by politics

 Senate Minority Leader Mitch McConnell opened the debate by accusing Democrats of being "irresponsible" for not passing a formal budget this year. "If you're looking for a simple, three-word description of the Democrat approach to the problems we face, it's this: duck and cover. They don't have a budget of their own. They're going to vote against their own president's budget later today and they're going to vote against every budget Republicans put up."

 "Republicans commandeered the floor by taking advantage of a seldom-used Senate rule that allows any senator to offer a budget if the Budget Committee has not passed a budget resolution by April 1.
In this case, Republicans called up five budgets: one that closely mirrored President Obama's budget proposal submitted earlier this year; another, authored by House Budget Chairman Paul Ryan, R-Wisconsin, which the House approved; and three from very conservative senators aimed at making drastic reductions to entitlements costs, government spending and taxes.
Romney, GOP try to shift focus to deficit

Going into the day, everyone knew none of the bills would get the 51 votes needed to succeed.
 
And, as Republicans had calculated, the president's budget got zero yes votes, providing Republicans with the political ammunition they sought for the campaign trail this year.

The House Republican budget got 41 Republican votes and zero Democratic votes. Five Republicans, including Sen. Scott Brown who is facing a tough re-election fight in Massachusetts, voted against it.

A proposal from Sen. Pat Toomey, R- Pennsylvania, that would balance the budget in eight years got 42 Republican votes and no Democratic votes.

A proposal from Sen. Rand Paul, R-Kentucky, that would cut eliminate several cabinet agencies -- including Commerce, Education, Housing and Urban Developments and Energy -- only got 16 votes.

And a proposal from Sen. Mike Lee, R-Utah, which would institute a flat tax, raise the eligibility age for Social Security, and repeal "Obamacare" only got 17 votes.

Senate Majority Leader Harry Reid (D-Nev.) indicated that he does not see a way to reach bipartisan agreement on deficit reduction or taxes before the November elections.

"The indictment said he crossed the line when he went to help raise money for a federal official.
In February 2007, Whittemore met with an elected official from Nevada, only identified in the indictment as “Federal Elected Official 1,” in Las Vegas, according to the federal indictment. FEC records suggest Senate Majority Leader Harry Reid is the elected official.
Whittemore, the indictment said, “agreed to act as a fundraiser to collect a target amount of $150,000 in campaign contributions for Committee B.”
The indictment says that in March 2007, Whittemore solicited employees of his company and their spouses to make the maximum donations to federal candidates, about $4,600 for individuals or $9,200 for couples.

In total, Whittemore and his associates contributed about $138,000 to the campaign.

Obama makes NRC nomination over Reid opposition

President Barack Obama nominated Kristine L. Svinicki for a new term on the Nuclear Regulatory Commission on Tuesday despite objections from Senate Majority Leader Harry Reid.
Svinicki has been caught in a dispute over NRC Chairman Gregory Jaczko, a former Reid aide who has been accused of intimidation and bullying. Svinicki has served on the NRC since 2008. In December, she and other commission members told Congress that Jaczko had created a tense workplace and that women felt especially threatened.

Svinicki, a nuclear engineer and former Senate aide, is one of two Republicans and the only woman on the five-member commission. Jaczko, a Democrat, has called the accusations "categorically untrue."
Senate Minority Leader Mitch McConnell, R-Ky., called for Svinicki's prompt confirmation.
Reid, D-Nev., has said previously that he opposed her nomination. His office declined to comment Tuesday.
Republican lawmakers have been pressuring the White House to renominate Svincki and have expressed dismay that her job appeared in jeopardy rather than's Jaczko's.
McConnell called Svinicki "one of the world's leading experts on nuclear safety" and said she has served with distinction on the commission for four years.........

Embattled Head of Nuke Agency to Step Down

The head of the U.S. Nuclear Regulatory Commission will resign once a successor is confirmed to run the nuclear safety agency.
NRC Chairman Gregory Jaczko said in a statement Monday that he plans to continue efforts to ensure public safety "in a different forum."
His resignation comes after fellow NRC commissioners publicly described Jaczko as acting as a bully.  And Jaczko's announcement comes less than two weeks after Senate Environment and Public Works Committee staff members were told of a pending NRC inspector general's report that expanded on the allegations that Jaczko was bullying staff. were. Last month, Jaczko "categorically" denied that he had been aggressive particularly against women.

Texas Voter ID Law, Which Accepts Gun Licenses But Not Student IDs, Challenged In Court

 'On Monday, the Department of Justice and the Texas Legislature will square off in court over Texas’ contentious voter ID law. A three-judge U.S. District Court panel will hear the case, which could challenge the Voting Rights Act of 1965.

Texas is one of nine states that must get any changes to their election law cleared by the DOJ under the Voting Rights Act due to a history of discrimination. Texas flunked the test; as Assistant U.S. Attorney General Thomas E. Perez wrote in his letter to the Director of Elections, “According to the state’s own data, a Hispanic registered voter is at least 46.5 percent, and potentially 120.0 percent, more likely than a non-Hispanic registered voter to lack this identification.
The law, SB 14, requires voters to show one of a very narrow list of government-issued documents, excluding Social Security, Medicaid, or student ID cards. Gun licenses, however, are acceptable.
The DOJ found that Texas’s SB 14 will “disenfranchise at least 600,000 voters who currently lack necessary photo identification and that minority registered voters will be disproportionately affected by the law.”
As of the 2010 Census, non-Hispanic whites have become the minority in Texas, shrinking to 45.3% of the population from 52.4%, while Latinos accounted for 65% of Texas’s population growth over the past decade.
But Latinos are not the only people hurt by the restrictive bill. People who want to vote but don’t have an ID will have to pay a fee to get one, like Jessica Cohen, whose story ThinkProgress documented in November. After she lost her identification during a robbery, the only way to get a voter ID was to pay a fee to Missouri officials in order to obtain her birth certificate.
On Monday, Texas will defend the law as a necessary measure to prevent voter fraud. Gov. Rick Perry (R-TX) argued that “Texas has a responsibility to ensure elections are fair, beyond reproach and accurately reflect the will of voters.” But the San Antonio Express-News reported that fewer than five “illegal voting” complaints involving voter impersonations were filed with the Texas Attorney General’s Office from the 2008 and 2010 general elections in which more than 13 million voters participated.
The Texas voter ID law isn’t the first the DOJ has had to combat. U.S. Attorney General Eric Holder noted,
“The past two years have brought nearly two dozen new state laws and executive orders, from more than a dozen states, that could make it significantly harder for eligible voters to cast ballots in 2012.”'

 Second, to make sure that a person arriving at a polling site is the same one who is named on the list, we propose a uniform system of voter identification based on the "REAL ID card" or an equivalent for people without a drivers license. To prevent the ID from being a barrier to voting, we recommend that states use the registration and ID process to enfranchise more voters than ever. States should play an affirmative role in reaching out to non-drivers by providing more offices, including mobile ones, to register voters and provide photo IDs free of charge. There is likely to be less discrimination against minorities if there is a single, uniform ID, than if poll workers can apply multiple standards. In addition, we suggest procedural and institutional safeguards to make sure that the rights of citizens are not abused and that voters will not be disenfranchised because of an ID requirement. We also propose that voters who do not have a photo ID during a transitional period receive a provisional ballot that would be counted if their signature is verified.

An ID was the recommendation for the Jimmy Carter and James Baker led commission.

Voter ID - Recommended by the Carter-Ford Commission & Long Overdue

 Here are a few excerpts from this 2005 Report on Election Reform. The report backs the argument requiring Voter ID is overdue and necessary. A country should value the vote of the citizens and even a poor country like Mexico has a Voter ID.  Mexico's national voter IDs part of culture

The REAL ID Act, signed into law in May 2005, requires states to verify each individual’s full legal name, date of birth, address, Social Security number, and U.S. citizenship before the individual is issued a driver’s license or personal ID card. The REAL ID is a logical vehicle because the National Voter Registration Act established a connection between obtaining a driver’s license and registering to vote. The REAL ID card adds two critical elements for voting — proof of citizenship and verification by using the full Social Security number."

 To improve ballot integrity, we propose that federal, state, and local prosecutors issue public reports on their investigations of election fraud, and we recommend federal legislation to deter or prosecute systemic efforts to deceive or intimidate voters. States should not discourage legal voter registration or get-out-the-vote activities, but they need to do more to prevent voter registration and absentee ballot fraud.'

 'Finally, we recommend strengthening and restructuring the system by which elections have been administered in our country. We propose that the EAC and state election management bodies be reconstituted on a nonpartisan basis to become more independent and effective. We cannot build confidence in elections if secretaries of state responsible for certifying votes are simultaneously chairing political campaigns, and the EAC cannot undertake the additional responsibilities recommended by this report, including critical research, without gaining additional funds and support.'

A state university says it's suspending its membership with the “Un-Fair Campaign.”

The campaign is a public service announcement running in Duluth that focuses on white privilege. The PSA argues that it’s hard for white people to see racism since they enjoy privileges others do not.


The University of Minnesota Duluth said last week that the campaign was divisive, but yesterday it went even further, saying it alienated alumni, supporters, and other people in Duluth.

'U.S. and Pakistani officials expressed optimism Monday that Islamabad was close to reopening its Afghan border to NATO troop supplies after a 7-month blockade, a move that could significantly reduce tension between the two countries.

 The tussle over the supply line, which Pakistan closed in November in retaliation for American airstrikes that killed 24 of its troops, has driven the bilateral relationship to new lows, threatening U.S. prospects in Afghanistan.'

 'The latest trip was a prime example of how "quiet diplomacy can play a significant role to get things done," the official said.
The U.S. addressed Pakistan's demands for higher transit fees by sweetening the deal with extensive road construction projects, the American official said, without providing specific figures.
Before the November attack, Pakistan was charging the U.S. $250 per truck. Afterward, Pakistan demanded $5,000 and the U.S. countered with $500. It's unclear where the deal stands now.'
