The Obama administration on Friday handed House Republicans reams of documents about the controversial “Fast and Furious” gunrunning operation even as lawmakers appealed their case to seek additional records.
After a long court case, the Department of Justice (DOJ) complied with a federal district judge's order that rejected the administration’s assertion of executive privilege over documents describing the botched operation.
Rep. Jason Chaffetz (R-Utah), chairman of the Oversight Committee, called the records “critical" to his panel's work.
“The committee has a duty to understand and shine light on what was happening inside DOJ during the time of this irresponsible operation. Yet DOJ has obstructed our investigative work for years,” Chaffetz said in a statement Friday.
“The committee, however, is entitled to the full range of documents for which it brought this lawsuit,” Chaffetz added. “Accordingly, we have appealed the District Court’s ruling in order to secure those additional documents.”
Sen. Chuck Grassley (R-Iowa), head of the Judiciary Committee, also called for the release of the remaining documents.
“Given that even after years of stonewalling these are only a fraction of the documents that were subpoenaed by the House of Representatives, at this point, the usefulness remains to be seen," Grassley said in a statement. "I look forward to seeing what was actually produced, and what President Obama continues to refuse to be transparent about. It shouldn't have taken a lengthy court battle to get this far. The rest of the documents should be turned over so that the litigation can end and the American people can know the whole truth.”
The release of documents to the House panel narrowly met the Friday afternoon deadline imposed by a January court order dismissing the Obama administration’s executive privilege argument.
In a letter to the committee, Assistant Attorney General Peter Kadzik indicated that the Obama administration wanted to put the matter behind it.
“[I]n light of the passage of time and other considerations, such as the department’s interests in moving past this litigation and building upon our cooperative working relationship with the committee other congressional committees, the department has decided that it is not in the executive branch’s interest to continue litigating this issue at this time,” Kadzik wrote.
Separate from the ruling on the executive privilege claim, the committee appealed other aspects of Judge Amy Berman Jackson’s decision, which kept documents about the Fast and Furious operation under wraps for other reasons.
Kadzik appeared to dispute the claim in his letter, saying that the material handed over by the Justice Department “fully satisfies the committee’s interest” in the issue.
The decision to hand over documents amounts to an admission of failure for the administration, which had long insisted that many of the records were not eligible for Congress's oversight.
In 2012, House Republicans sued to obtain documents about the operation after first voting to hold then-Attorney General Eric Holder in contempt for refusing to hand them over.
The widely derided Fast and Furious program ran from 2009 to 2011 as a plan to track guns by purposely allowing them to move from low-level buyers up through Mexican drug cartels.
Many of the weapons eventually turned up in the hands of cartel members. One was at the site of a 2010 shootout that left a U.S. Border Patrol agent dead. Another was found in the hideout used by Sinaloa Cartel leader Joaquín “El Chapo” Guzmán before his arrest in January.

An Arizona gun store says it has canceled a recent purchase of an AR-15 semiautomatic rifle by Mark Kelly thwarting the retired astronaut's attempt to demonstrate how easy it is to buy high-powered weapons.
Kelly, the husband of former Rep. Gabby Giffords and an outspoken advocate for new gun control measures, had in recent interviews said he was buying the rifle to showcase what he said are unobtrusive background checks
Doug MacKinlay, owner of Diamondback Police Supply, said it was Kelly's statements that caused him to stop the sale.
"I determined that it was in my company's best interest to terminate this transaction prior to his returning to my store to complete the Federal Form 4473 and NICS (National Instant Criminal Background Check System) required of Mr. Kelly before he could take possession of this firearm," MacKinlay posted on the Tuscon store's Facebook page Monday.
MacKinlay said he sent a full refund to Kelly and nixed the transaction because Kelly made statements in the media that the rifle purchase was "for reasons other then (sic) for his personal use."
Kelly could not immediately be reached for comment Tuesday

The father of Alison Parker, the Virginia reporter who was killed by a former co-worker Wednesday, criticized his state's two senators for not calling him yet.
Andy Parker said Friday that Virginia Gov. Terry McAuliffe was the first elected official to call him but that he had not heard from Sens. Tim Kaine (D) and Mark Warner (D).
“I have not heard a word from Sen. Kaine. And I have not heard a word from Sen. Warner," Parker said, according to CNN.
Parker ran an unsuccessful run for the Virginia House of Delegates in 2007 as a Democrat and interacted with the men on the campaign trail.
"They campaigned for me when I ran for the House of Delegates. And it's very disappointing that Sens. Kaine and Warner haven't at least given me a call and come out against this," he said.

Vester Lee Flanagan II, a former reporter at Alison Parker's TV news station, WDBJ, shot and killed both her and Adam Ward, a photojournalist. Flanagan also shot the woman they were interviewing, Vicki Gardner, who is expected to recover.
What facts have we learned from the shooting so far in Roanoke ? The killer legally bought his weapon and passed the background check since he did not have a criminal record. Five years before he was shot to death in the failed terrorist attack in Garland, Texas, Nadir Soofi walked into a suburban Phoenix gun shop to buy a 9-millimeter pistol.
At the time, Lone Wolf Trading Co. was known among gun smugglers for selling illegal firearms. And with Soofi's history of misdemeanor drug and assault charges, there was a chance his purchase might raise red flags in the federal screening process.
Inside the store, he fudged some facts on the form required of would-be gun buyers.
What Soofi could not have known was that Lone Wolf was at the center of a federal sting operation known as Fast and Furious, targeting Mexican drug lords and traffickers. The idea of the secret program was to allow Lone Wolf to sell illegal weapons to criminals and straw purchasers, and track the guns back to large smuggling networks and drug cartels.
Intentions of the program were to help arm a chosen cartel and to help push gun control in the U.S.
Instead, federal agents lost track of the weapons and the operation became a fiasco, particularly after several of the missing guns were linked to shootings in Mexico and the 2010 killing of U.S. Border Patrol Agent Brian Terry in Arizona.
Soofi's attempt to buy a gun caught the attention of authorities, who slapped a seven-day hold on the transaction, according to his Feb. 24, 2010, firearms transaction record, which was reviewed by the Los Angeles Times. Then, for reasons that remain unclear, the hold was lifted after 24 hours, and Soofi got the 9-millimeter.
As the owner of a small pizzeria, the Dallas-born Soofi, son of a Pakistani American engineer and American nurse, would not have been the primary focus of federal authorities, who back then were looking for smugglers and drug lords.
He is now.
In May, Soofi and his roommate, Elton Simpson, burst upon the site of a Garland cartoon convention that was offering a prize for the best depiction of the prophet Muhammad, something offensive to many Muslims. Dressed in body armor and armed with three pistols, three rifles and 1,500 rounds of ammunition, the pair wounded a security officer before they were killed by local police.
A day after the attack, the Department of Justice sent an "urgent firearms disposition request" to Lone Wolf, seeking more information about Soofi and the pistol he bought in 2010, according to a June 1 letter from Sen. Ron Johnson (R-Wis.), chairman of the Senate Homeland Security Committee, to U.S. Atty. Gen. Loretta Lynch.
Though the request did not specify whether the gun was used in the Garland attack, Justice Department officials said the information was needed "to assist in a criminal investigation," according to Johnson's letter, also reviewed by The Times.
The FBI so far has refused to release any details, including serial numbers, about the weapons used in Garland by Soofi and Simpson. Senate investigators are now pressing law enforcement agencies for answers, raising the chilling possibility that a gun sold during the botched Fast and Furious operation ended up being used in a terrorist attack against Americans.

The Washington Post reports the jailbreak of drug kingpin Joaquin 'El Chapo' Guzman from prison in Mexico. The Mexican government and the Obama administration's connections to Guzman are nothing short of criminal. Guzman heads the Sinaloa drug cartel, the most powerful in Mexico and it happens to control the drug trade in Chicago . This was the same drug cartel that was armed with 'assault weapons' by the ATF under Barack Obama and Eric Holder. The same administration that uses increasing gun violence in Mexico to push for more gun control in the United States.
MEXICO CITY — Joaquin “El Chapo” Guzman, the world’s most famous drug lord, has escaped from a maximum security prison in Mexico for the second time in his drug-running career, a spectacular breach of security that set off a massive manhunt in the early hours Sunday.
For the past year and a half, the leader of the Sinaloa cartel had been incarcerated inside the Altiplano, a federal facility set amid farmland west of the capital that holds the top captured drug bosses and has been described as the country’s most impenetrable prison.
That all changed late Saturday night, when Guzman slipped out of the prison through a rectangular passage in the shower area of his cell that led to a nearly mile-long tunnel running underneath the prison, according to Mexico’s national security commissioner, Monte Alejandro Rubido.
The Associated Press video reports that this is his SECOND escape from prison in Mexico.

In a brief morning news conference, Rubido said that Guzman was last seen inside the prison around 8 p.m. while receiving his daily dose of medication. After guards realized he had disappeared, they found the hatch that led by ladder down to the tunnel, which was illuminated, perforated with PVC piping for ventilation and equipped with adapted motorcycle-on-rails to whisk the drug lord to freedom.
The escape of Guzman is a staggering blow for Mexican President Enrique Peña Nieto, who had been building a strong reputation for arresting top drug bosses from all the major cartels. However, as his administration has succeeded in weakening some cartels, such as the Zetas and the Knights Templar, others are now ascendant, including the New Generation cartel in Jalisco.
But the failure to hold the country’s most important drug trafficker reveals the weakness of Mexico’s justice system and will add to the perception that the state has become so riddled with corruption that powerful criminals can in fact exist above the law.
The manner of Guzman’s escape suggests that his rescue operation was well-planned and financed and may have occurred with the complicity of officials inside the prison.
But in the Sinaloa Cartel, Guzman still has a large and lucrative drug-running operation to welcome him back into the fold.
In February 2014, Guzman was captured by a team of Mexican commandos while he was sleeping in the Miramar condominium in the beach town of Mazatlan. The arrest came after a series of military operations, which relied heavily on intelligence gathered by U.S. law enforcement officials, that led to houses with their own elaborate tunnel network in the Pacific Coast state of Sinaloa that Guzman had used to evade capture for years.

The escape promises to be a major irritant in the relations between the U.S. and Mexican governments. American officials had pressed for Guzman’s extradition so that he could be prosecuted for drug crimes and held in the type of facility where he would be more secure. But Mexican officials took it as a point of pride and national sovereignty that they could hold even drug traffickers as powerful as Guzman in prison.

Democrat Leland Yee, an anti-gun crusading Senator from California agreed to a very lenient plea deal with the government. The one felony count of racketeering is just a slap on the wrist considering his links to gangsters and Muslim terrorists, let alone committing first degree hypocrisy. The California government is controlled by the Democrats so this special treatment isn't unexpected and the left leaning national media ignoring the story isn't a surprise either. SAN FRANCISCO - Former state Sen. Leland Yee faces up to 20 years in prison and a $250,000 fine after a deal in federal court Wednesday in which he pleaded guilty to one felony count of racketeering.
The San Francisco Democrat was one of more than two dozen people arrested last year as part of a sweeping federal investigation into a Bay Area organized crime ring run by Raymond “Shrimp Boy” Chow, a longtime associate of Yee’s. He will be sentenced on Oct. 21.
The plea agreement is the culmination of a stunning political collapse for Yee, who spent more than a decade in the Legislature and was running for secretary of state when he was arrested in March 2014. Days later, he was suspended from the Senate with pay, and he served the remaining months of his term in exile.
Yee declined to speak with the media as he left the courthouse. Before getting into a car waiting out front, he shook hands with two security guards who had escorted him from the building. His attorneys could not be reached for comment.
At the start of the hearing, Yee briefly sat with the media, smiling and joking. But his demeanor changed as he approached the bench. He spoke quietly, giving mostly one- or two-word answers.
“Guilty,” Yee said, when asked by Judge Charles Breyer how he was pleading.
“Are you pleading guilty of your own free will, because you are guilty?” Breyer asked.
“I am,” Yee said.
As part of the agreement, Yee admitted to exchanging political favors for campaign contributions, including:
▪ $10,000 to help a business secure a contract with the California Department of Public Health. According to the revised indictment, Yee met with undercover agents representing a software consulting company client, Well Tech. One of the agents said he wanted to position Well Tech to compete for state grants and contracts.
▪ $6,800 to issue a proclamation honoring a community organization in Chinatown that prosecutors allege is connected to criminal activities. According to the indictment, Yee gave the proclamation to Chee Kung Tong at a celebration of the group’s anniversary.
▪ $11,000 to introduce an undercover FBI agent to another state senator with influence over medical marijuana legislation. Senate Minority Leader Bob Huff has said he thinks he was “State Senator 2” in the affidavit. He said he met with Yee and “some long-haired guy in plain clothes” to discuss Republicans’ views on the legislation.
Yee also admitted to conspiring to extort several individuals who, at the time, had an interest in pending legislation extending the state athletic commission and changing the workers’ compensation program for professional athletes.
And he acknowledged offering to facilitate a multimillion-dollar arms deal for shoulder-fired missiles and automatic weapons with a source tied to Muslim rebel groups in the Philippines – a particularly bizarre and damaging allegation for the staunch gun-control advocate.
Experts said Yee likely accepted the plea because of the weight of evidence against him, but were unsure whether it indicated that he had agreed to cooperate with the prosecution going forward. The U.S. attorney’s office in San Francisco declined to comment.
Review to Probe Uptick in Violence After Stop-and-Frisk Cutback
The New York Police Department is analyzing years of data to determine if the decline in the number of stop, question and frisks is having an impact on crime in the city, Commissioner William Bratton said Wednesday
The study comes as overall crime continues to decrease, but as the department grapples with an uptick this year in violence, particularly shootings, in certain neighborhoods.
"We have a very comprehensive analysis under way right now," Mr. Bratton said after an unrelated event at police headquarters. "At this juncture, we really don't know. Once that study is completed over the next several weeks, we'll have a better idea of that."
Mr. Bratton has said in the past that he doesn't believe there is any correlation between the decreasing number of stops and shooting increases, but ordered the study anyway.
A law-enforcement official said the commissioner ordered the study earlier this week during a weekly meeting with NYPD three-star chiefs and top officials to discuss crime numbers.
The NYPD is laying out its annual plan to deal with summer crime. Precincts that have been plagued by gun violence will be flooded with new recruits who graduate on Monday.
The official, who has direct knowledge of the meeting, said Mr. Bratton was concerned about the recent uptick in shootings and went around the room asking for solutions.
Unsatisfied with the answers, he ordered a study that looks at noticeable trends contributing to the uptick and if there is any correlation to the drop in 250 reports—the form officers fill out after conducting a stop.
Some criminologists welcomed comprehensive analysis.
With the decreasing number of stops, "one should expect some increase in crime numbers," said Richard Rosenthal, a criminology professor at the University of Missouri-St. Louis, who published a 2014 study that said it was difficult to determine the relationship between stops and crime.
"Crime has not shot up" citywide, he added, "so that suggests to me that the relationship between crime and stop-and-frisk may be pretty weak."
The stops are a controversial tactic that Mayor Bill de Blasio has promised to change.
A federal court judge found that the NYPD was unconstitutionally using tactic to target minorities, particularly African-American and Hispanic men. The court installed a monitor to oversee changes and the decision is pending approval.
The tactic's use peaked at more than 686,000 stops citywide in 2011 under former Commissioner Raymond Kelly, before it began significantly decreasing in the years after.
According to most recently available quarterly reports, police officers conducted 14,261 stops from Jan. 1 to March 31 of this year, compared with 99,788 for the same period in 2013, according to the NYPD.
"Twenty years of crime data make it clear that stop-and-frisk is not the key to making our city safer," said Christopher Dunn, the New York Civil Liberties Union associate legal director.
According crime numbers compiled through Sunday, the NYPD has received 48,754 reports for major crimes across the city—a 2.5% decrease from the same period last year. The number of shooting incidents has increased 11%.
A particular cause for concern is the increase in shootings in recent weeks, police officials said.
In the past 28 days through Sunday, shooting incidents increased to 114 from 98, a 16% increase from the same period last year.

Backed with millions of dollars and potentially millions of supporters, a new group aiming to curb gun violence will launch Wednesday.
Everytown for Gun Safety will include Mayors Against Illegal Guns, founded by former New York City Mayor Michael R. Bloomberg and former Boston Mayor Tom Menino, and Moms Demand Action for Gun Sense in America, a grassroots movement of mothers.
That group was founded the day after the elementary school shooting in Newtown, Conn.
According to a press release, "Everytown will ask Americans to join the fight to reduce the gun violence that kills 86 Americans every day and affects every town – big cities and small towns alike. This means continuing to press for change in Washington and moving beyond Congress to bring the fight for common-sense gun policies to state capitols, corporate boards, and state and federal elections – fields of play formerly occupied almost solely by the gun lobby."

outlaws the weapon used by Lanza and also allows the state to

Cuomo was asked during a radio interview yesterday about

the measure. He said his own surveys of voters as he pushed the
gun law showed support would likely suffer as a result.
“I know they’re going to be displeased,” Cuomo said. “I

will be that. They will be unhappy.”
