Barack Obama's Illegal Covert War in Syria

Barack Obama and his administration's secret war against Assad in Syria will always be framed in a different light.  The coup in Libya under the guise of the 'responsibility to protect doctrine' or R2P and the resulting chaos in Libya has been a disaster for the entire middle east.  The attack on the Special Mission in Benghazi and the transfer of weapons from Libya to Syria, via Turkey, exposed Obama's secret and unconstitutional war long ago. Just as Turkey is using the war on ISIS as an opportunity to attack the Kurds, Obama is now using the war on ISIS to target Assad. 

 This RAT LINE of military arms from Libya directly and indirectly aided ISIS in Syria, a group that Obama has done little to confront and who the POTUS called the 'jayvee team'.  ISIS, a group that this administration uses to fight Assad.  Obama's ISIS army only became a problem for him when they streamed into Iraq when the POTUS withdrew our troops, thus surrendering the territory to ISIS and Iran.

The Obama administration's power under the AUMF to conduct war in Syria have been questionable from the beginning and the actions under Article 2  now are politely described as ' blurry' as the following story excerpted from TheHILL describes

White House Legal Strategy for ISIS Fight Gets Blurry
President Obama has shifted his legal rationale for justifying military force to defend Syrian rebel forces battling the Islamic State in Iraq and Syria as the prospect has increased that they could come into conflict with Syria’s government.

The administration had been using a 2001 authorization approved by Congress after the Sept. 11 attacks to justify air strikes against ISIS.

But the administration now says it will also rely on Article II of the Constitution as the legal backing for air strikes against Syrian leader Bashar al-Assad’s forces if Assad attacks the rebel groups.

“If Syrian government forces attack the Syrian fighters we have trained and equipped while they were engaging ISIL, the President would have the authority under Article II of the Constitution to defend those fighters,” a senior administration official told The Hill, using another acronym to describe ISIS.

The legal shift comes as the Syrian rebels are beginning to deploy back into Syria from their training sites.

This is raising the prospect that they will come into conflict with Assad’s forces, prompting the need for a U.S. response.

And the U.S. is not only protecting the rebels they've vetted and trained, but the entire groups that they were recruited from and return to — many of which the U.S. has not vetted.

In fact, a U.S. official said, the U.S.-led coalition already is providing those groups with air support against ISIS – even though they do not yet have U.S.-trained rebels embedded with them.

The diplomatic official said some of the groups may target Assad — which would bring the U.S. closer to war with the regime.

Already, things have not gone as planned. Although the rebels were trained to fight ISIS, the first rebels to return almost immediately came under attack by al Nusra — an al Qaeda affiliated group, prompting coalition airstrikes. 
The administration maintains the U.S. can defend the rebels from al Nusra — al Qaeda's affiliate in Syria — using the 2001 AUMF.

So far, there has been no conflict with Syrian forces.
Both the expansion of the fight, and the shifting rational for its legality has drawn criticism from Congress.

Legal scholars said using Article II to justify defensive actions as protecting the rebel groups from Assad is a stretch.
“That means nothing. That’s pretty bad when you have to cite Article II…You have to be more specific than that,” said Louis Fisher, scholar in residence at the Constitution Project and former Congressional Research Service researcher.

He and other legal experts say Article II has been interpreted to allow a president to “repel sudden attack” against U.S. troops, the U.S.mainland, and its interests.

Using it to defend Syrian rebels would not fit under that previous interpretation, he said.
“Invoking Article II is question-begging,” agreed Stephen Vladeck, law professor at American University.

Vladeck said Article II has also been interpreted to allow the U.S. to defend its “assets.”
However, he said “by that logic any person or piece of military equipment used by anyone on a side of a conflict with which we agree is all of a sudden covered by Article II. And that cannot be right.” 
As recently as last month, Marine Gen. Joseph Dunford, the incoming chairman of the Joint Chiefs of Staff, told the Senate Armed Services Committee that the U.S. did not have the authority to conduct airstrikes against the Syrian regime. 
“My understanding is that we don't have the legal authority at this time to go after the Assad regime. And it's also the policy of the administration not to go after the Assad regime militarily,” he said at a hearing on July 7. 
The administration now is saying it will conduct “offensive” strikes against ISIS that would be justified by the 2001 AUMF, use the same AUMF to justify “defensive” strikes against al Nusra, and use Article II to justify “defensive” strikes to defend the rebels against the regime.
Some lawmakers are becoming increasingly uncomfortable with the blurred lines, one year after the airstrikes against ISIS first began.
The Nobel Peace Prize winner Barack Obama and his administration has wanted to directly attack Assad for years and only when they sought political cover by involving Congress at the last minute was this averted. The reasons for opposing Obama's 'intervention' in Syria were numerous and the public opposed his actions as well. 

The Obama administration has never been honest about Syria. In fact, they have always lied about Syria at every opportunity. The claims that the Assad regime solely using chemical weapons against the Syrian people and was a cause for war or Obama and his administration claiming they destroyed Assad's chemical weapons arsenal and enforced the chemical weapons treaty are lies. Further 'blurring' the lines of Constitutional power really isn't a problem for this corrupt and dishonest administration.

Democrat Fraudster & Rapist (Sentence Commuted by Bill Clinton) in Trouble Again

Another Democrat is in the news today.  Of course this rapist, liar, fraudster and tax cheat is a friend of the Clintons and has a lot in common with Bill Clinton, the former Rhodes Scholar.

Former Rep. Mel Reynolds (D-Ill.) was indicted Friday on charges that he didn’t file federal income tax returns for four straight years. 
The grand jury indictment states that Reynolds, who served in Congress from 1993 to 1995, failed to file returns from 2009 to 2012, the Associated Press reported
While no arraignment date has been set, each of the four counts carries a maximum sentence of one year in prison and $250,000 fine on conviction. 
The 63-year-old former lawmaker and Rhodes Scholar was previously convicted by a state court in 1995 on sexual assault and sexual abuse charges involving an underage campaign volunteer who worked on his 1992 run. 
Reynolds was sentenced to five years in prison and forced to resign from Congress. While in prison, he was convicted of, among other things, bank fraud and making false statement to the Federal Election Commission
President Clinton eventually commuted his sentence. 
In 2012, Reynolds launched an unsuccessful bid for to return to Congress, after former Rep. Jesse Jackson Jr. (D-Ill.) resigned from his post after pleading guilty to misusing $750,000 in campaign funds. 
Last year, Reynolds was arrested and jailed in Zimbabwe on charges he had sexually explicit photos and videos on his mobile phone in violation of a censorship law, according to the Chicago Tribune
Authorities dropped the pornography charges and Reynolds pleaded guilty to a lesser visa violation. He was deported back to the U.S.

Congress Rams Medicare 'Doc Fix' Bill Through Using Voice Vote in Near-Empty Congress

The House on Thursday approved legislation by voice vote that prevents a pending cut to Medicare physician rates for another year.
The move, which dodges a 24 percent cut to those rates set to hit on April 1 without congressional action, came after a lengthy delay in which the bill's passage appeared in doubt.
House passage is essentially a take-it-or-leave-it offer to the Senate, which now must decide how to react with just days left before the cut takes effect.
House Republicans called the bill up under a suspension of House rules, which meant a two-thirds majority was needed for passage, and that 50 to 60 Democrats had to support it. That led to worries all day that the House would not be able to pass it due to Democratic opposition. 
Republicans considered pulling the measure as serious questions were raised about whether enough Democrats were there to reach the two-thirds majority. But the voice vote appears to have been a way to avoid a potentially failed vote on a bill that both GOP and Democratic leaders said must pass

Angry House conservatives denounced the Republican leadership for abruptly ramming through a fix to Medicare doctor payments on Thursday without a full roll call vote.
“Outrageous,” Rep. Louie Gohmert (R-Texas) told The Hill after complaining about the maneuver to a colleague. “I think it’s outrageous.”

House Republican leaders had planned to bring up the “doc fix” under a procedure requiring a two-thirds majority to pass, but after a series of closed-door meetings on Thursday morning, they determined they didn’t have the votes to meet that threshold and didn’t want to stay in session long enough to set up a simple majority vote.So with just a few members on the House floor before a scheduled vote on an unrelated Ukraine measure, Republicans brought up the Medicare bill by voice vote. When no one in the chamber objected, the measure passed.
“Bullshit,” said a visibly annoyed Rep. Mick Mulvaney (R-S.C.) as he emerged from the floor following the Ukraine vote. When Mulvaney was asked to comment about the upcoming GOP budget, he replied: “I can’t talk about the budget because I’m so pissed about the [doc fix].”

The measure is an annual delay to the sustainable growth rate formula that this time would prevent a 24 percent cut in Medicare reimbursement payments to doctors set to begin at month’s end. The change is broadly supported by Republicans and Democrats most years, but it drew opposition from the American Medical Association, which has pushed for a long-term solution to the problem instead of annual patches. House and Senate leaders have agreed on a resolution to repeal the formula, but they can’t agree on how to pay for the $180 billion cost over a decade, necessitating the stopgap measure.
Rep. John Fleming (R-La.), a member of the “Doctor’s Caucus” that opposed the bill, said he didn’t like the maneuver but did not object because, he said, the alternative of payment cuts to doctors was worse.
“This would affect millions of seniors across the country in a very negative way,” he said.
“I didn’t like the way we did that,” Fleming added. “They gave us a choice between something bad and something worse.”

With little argument, the House of Representatives approved measures Wednesday that would prevent the Obama administration from spending money on U.S. military operations in Syria without consulting Congress and would forbid funding U.S. military or paramilitary operations in Egypt.
The measures, part of the House’s $598 billion defense bill, were supposed to be contentious issues exposing bipartisan rifts between interventionists who want to give Obama a free hand in dealing with the civil war in Syria and unrest in Egypt and war-weary lawmakers concerned that U.S. troops will be dragged into more military actions.
But both amendments were approved on voice votes with only scant dissent.
On Syria, lawmakers passed an amendment by Rep. Trey Radel, R-Fla., that would forbid any military action in Syria if it violates the War Powers Resolution – which requires the president to consult Congress before committing U.S. forces to battle or placing them in situations where hostilities are imminent.
The Radel amendment does not address the contentious issue of providing weapons to the Syrian rebels, whose campaign to topple President Bashar Assad is made up of as many as 1,200 largely independent groups, including some that are openly affiliated with al Qaida. Congressional intelligence committees recently signed off on an Obama administration proposal to have the CIA funnel unspecified arms and training to rebels aligned with the moderate Supreme Military Council, led by a defected Syrian general, Salim Idriss.

But the wording of the amendment would apply to setting up a no-fly zone or using U.S. ships to launch attacks on sites in Syria, and the debate showed that deeper military involvement in Syria is opposed by an unusual House coalition of conservative Republicans and liberal Democrats.
“I believe without a shadow of a doubt this is one of the most insane policies that borders on madness – the United States to give funding, training and arms most likely to al Qaida in Syria doesn’t make any sense,” said Rep. Michele Bachmann, R-Minn. “This is absolute madness.”
Rep. Peter Welch, D-Vt., agreed, calling the situation in Syria “chaotic.”
“Distinguishing between the good rebels and the bad rebels is impossible,” Welch said on the House floor. “The notion that we can have a micromanaged approach and pick the good guys, and arm them, and not have any reasonable . . . expectation that the arms will get into bad hands I think is naive.”
Welch added that Congress has the responsibility to weigh in before U.S. troops are sent into harm’s way.
“We have a job to do under the Constitution,” he said.
The Obama administration last month notified Congress under the War Powers Resolution that a detachment of 700 U.S. troops who’d been participating in war games in Jordan would remain in that country “until the security situation becomes such that it is no longer needed.” The detachment includes Patriot anti-missile systems and fighter aircraft, the White House notification said.

Obama's Domestic Electronic Surveillance - Web of Deception

"Does the NSA collect any type of data at all on millions or hundreds of millions of Americans?" committee member Sen. Ron Wyden (D-Ore.) asked Clapper during the March 12 hearing.
In response, Clapper replied quickly: "No, sir." 
All Ears
"There are cases where they could inadvertently perhaps collect [intelligence on Americans], but not wittingly," the U.S. intelligence chief told Wyden and the rest of the committee.
That said, "particularly in the case of NSA and CIA, there are structures against tracking American citizens in the United States for foreign intelligence purposes," Clapper added.
Both agencies are focused on foreign intelligence collection, "and that's what those agencies are set up to do," he added.
Conducting surveillance on Americans inside U.S. borders is something "they do not engage in," the intelligence chief added.

Exclusive: Top secret court order requiring Verizon to hand over all call data shows scale of domestic surveillance under Obama
"The National Security Agency is currently collecting the telephone records of millions of US customers of Verizon, one of America's largest telecoms providers, under a top secret court order issued in April.
The order, a copy of which has been obtained by the Guardian, requires Verizon on an "ongoing, daily basis" to give the NSA information on all telephone calls in its systems, both within the US and between the US and other countries.
The document shows for the first time that under the Obama administration the communication records of millions of US citizens are being collected indiscriminately and in bulk – regardless of whether they are suspected of any wrongdoing.
The secret Foreign Intelligence Surveillance Court (Fisa) granted the order to the FBI on April 25, giving the government unlimited authority to obtain the data for a specified three-month period ending on July 19."

Within hours of the disclosure that federal authorities routinely collect data on phone calls Americans make, regardless of whether they have any bearing on a counterterrorism investigation, the Obama administration issued the same platitude it has offered every time President Obama has been caught overreaching in the use of his powers: Terrorists are a real menace and you should just trust us to deal with them because we have internal mechanisms (that we are not going to tell you about) to make sure we do not violate your rights.

Those reassurances have never been persuasive — whether on secret warrants to scoop up a news agency’s phone records or secret orders to kill an American suspected of terrorism — especially coming from a president who once promised transparency and accountability.
The administration has now lost all credibility on this issue. Mr. Obama is proving the truism that the executive branch will use any power it is given and very likely abuse it
