DAPL Protester Accused in Shooting Reaches Plea Deal

BISMARCK, N.D. (AP) — A Denver woman accused of shooting at law officers during protests in North Dakota against the Dakota Access oil pipeline has reached a deal with prosecutors to avoid trial. 

Attorneys for Red Fawn Fallis said the decision was based on anti-protester sentiment in the area and unsuccessful attempts to have a judge order the prosecution to turn over more information, including details about an FBI informant Fallis alleges seduced her and owned the gun. 

"Red Fawn has been fighting an uphill battle at every stage of this case," her attorneys said in a statement late Tuesday. 

U.S. Attorney Chris Myers on Wednesday declined comment until after the case is resolved.

Fallis was to stand trial in federal court in Fargo beginning Jan. 29 on accusations that she fired a handgun three times during her October 2016 arrest. No one was injured.
She earlier pleaded not guilty to civil disorder and weapons charges, including illegal possession of a gun by a convicted felon. She has a 2003 conviction in Colorado for being an accessory to a felony crime. 

Fallis is now scheduled to plead guilty Monday in federal court in Bismarck to the civil disorder and gun possession counts. Prosecutors would drop a more serious weapons charge — discharge of a firearm in relation to a felony crime of violence — that carries a minimum prison sentence of 10 years and the possibility of life. Prosecutors also would recommend no more than seven years, according to Fallis' attorneys. 

U.S. District Judge Daniel Hovland must approve the plea deal, and he could sentence Fallis to up to 10 years. 

"Red Fawn has made the very difficult decision to enter into a plea agreement that still risks significant prison time, but removes the mandatory minimum and the possibility of life imprisonment," her attorneys said.

CINCINNATI, Ohio --Police have released body camera footage showing the moment a Cincinnati police officer shot a motorist during a traffic stop over a missing front license plate.
Authorities said 25-year-old Officer Ray Tensing spotted a car driven by 43-year-old Samuel DuBose and a struggle ensued after DuBose refused to provide a driver's license and get out of the car.

The reflexive action by this officer most likely saved  lives of other people, including his own. Attempting to resist arrest and injuring this officer was not only intentionally reckless, but what would have been the results of a police chase ? Consider these facts from USA Today 

More than 5,000 bystanders and passengers have been killed in police car chases since 1979, and tens of thousands more were injured as officers repeatedly pursued drivers at high speeds and in hazardous conditions, often for minor infractions, a USA TODAY analysis shows. 

The bystanders and the passengers in chased cars account for nearly half of all people killed in police pursuits from 1979 through 2013, USA TODAY found. Most bystanders were killed in their own cars by a fleeing driver. 

While the point of the USA Today article might question the value of police chases for 'minor' offenses, it ignores the other criminal charges that the driver is seeking to avoid by fleeing.  Just take the driver in Cincinnati for example.  No front plate, no license or insurance, a bottle of booze, resisting arrest, assaulting a police officer and possible property damage, injury and death when the driver flees. The facts are a 50 cent bullet prevented a much worse ending to this traffic stop that was turning into another police chase. .

New Evidence in Michael Brown Incident Clears Police

Initial reports of a gentle giant etc contrasts sharply with the strong arm robbery assault on the merchant and attacking  a policeman. The narrative seems to remain that the conduct of the police should only be questioned.  The talking points from the Mike Brown supporters seem to fall apart further every day. A simple youtube video provides some great insight into the Mike Brown incident.

Eye Witness Audio of Mike Brown Shooting States: “Brown Doubled Back Toward POlice”…

The video was taken in the aftermath of the shooting, and judging from the comments attributed to the uploader -although he was not a direct witness- he felt the video was affirmational toward Mike Brown and the anti-police narrative.

However, probably unknown -or at least unnoticed- in the background of the video you can hear an audio conversation of a male eye witness to the shooting itself describing what he saw to another curious male spectator. Again, the conversation of importance is in the background.

*Most importantly, that description of events matches other witnesses and accounts such as the following: 

FIRST, The friend describes the event -as told to her by Wilson- as follows:

He pulled up ahead of them. And then he got a call-in that there was a strong-arm robbery. And, they gave a description. And, he’s looking at them and they got something in their hands and it looks like it could be what, you know those cigars or whatever. So he goes in reverse back to them. Tries to get out of his car. They slam his door shut violently. I think he said Michael did. And, then he opened the car again. He tried to get out. He stands up.
And then Michael just bum-rushes him and shoves him back into his car. Punches him in the face and them Darren grabs for his gun. Michael grabbed for the gun. At one point he got the gun entirely turned against his hip. And he shoves it away. And the gun goes off. 

Well, then Michael takes off and gets to be about 35 feet away. And, Darren’s first protocol is to pursue. So, he stands up and yells, “Freeze!” Michael and his friend turn around. And Michael taunts him… And then all the sudden he just started bumrushing him. He just started coming at him full speed. And, so he just started shooting. And, he just kept coming. And, so he really thinks he was on something.” (link)
